US Judge Mandates Release of Abrego Garcia from ICE Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her order, the judge noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
